If there is no police report of this accident, can I still make a claim?

Yes.  Although a police report is very helpful, it is not necessary to make a claim or prosecute a lawsuit.  Truthful testimony by the person injured can establish negligence on the part of the person who caused the collision.

How do I pay for my medical treatment?

If you were on the job at the time you were injured, your employer’s workers’ compensation insurance has the obligation to pay for all reasonable and necessary medical treatment.  If you were not on the job, your personal health insurance or your company’s health insurance is responsible to pay for reasonable and necessary medical care.  If you are uninsured, keep in mind that your own automobile insurance coverage normally includes coverage which is referred to as “Personal Injury Protection.”  Your Personal Injury Protection will reimburse you for your medical bills up to the maximum coverage you have on your own automobile insurance policy.

Should I allow the insurance company to take a tape recorded statement from me?

Please understand that you are not legally required to allow anyone to tape record a conversation with you.  If requested to provide a written or tape recorded statement, it is recommended you first discuss your legal rights by speaking with a Texas automobile accident lawyer, such as Steve McCarthy.
