Repeat DWI Offender in Houston Crashes into a Driver Who was Changing a Flat Tire

Is there any form of legal recourse a surviving family dealing with similar circumstances can take?

It was around 7:20 p.m. on September 3, 2019, when a 55-year-old man pulled his Ford Taurus off to the shoulder of the South Loop just before Highway 288 to change a flat tire [Source: ABC 13 News]. While changing his tire, the man’s vehicle was struck from the rear by a pickup truck being driven by a 60-year-old man. Both the victim and the driver of the truck had to be transported to Ben Taub Hospital, however, it was the victim who did not survive the accident.

Authorities later determined that  the driver of the pick-up had been intoxicated at the time of the wreck and that he had previous encounters with the law. According to the news source,  the driver of the truck had at least three DWI convictions on his record already. Because of his past criminal history and the fatal accident he caused, the Chief of the Vehicular Crimes Division for the district attorney’s office said that they were asking that  the driver be held without bond.

Can the surviving family of a drunk driving accident victim sue a driver for the wrongful death of their loved one?

Alcohol-related accidents are occurring at an alarming rate. According to Mothers Against Drunk Driving (MADD), “every day in America, another 30 people die as a result of drunk driving crashes.” That is equivalent to one person being killed every 48 minutes.

When filing a wrongful death lawsuit on behalf of a loved one, you are going to be required to prove negligence, which is often easier to do once a drunk driver has been convicted of DWI along with other charges that have been filed against him/her. You are also going to need to determine which damages you are entitled to recover that should be included in your lawsuit.
