USA TODAY Covers Blizzard Greenberg Lawsuit Against Aramark Over Child Sexual Assault

USA TODAY reported on a lawsuit Blizzard Greenberg filed on behalf of a Houston family against Aramark and one of its employees after an incident involving the reported sexual assault of an 8-year-old boy at NRG Stadium.

In the article, the child’s parents describe the emotional impact of the incident and the changes they have seen in their son since the assault.

“How is he going to feel in the future trusting employees in places?” one of the parents told USA TODAY. “It just unfortunately really starts to take away trust of adults and people that you believe you should be able to trust. And now it’s kind of shattered.”

The article also recounts the child telling his parents, “I just wish Santa could give me an eraser to take it out of my head.”

Houston prosecutors have charged the employee, Ushay Nixon, with indecency with a child and attempted aggravated sexual assault of a child under age 14. The criminal case remains pending.

Parents File Lawsuit Accusing Aramark Employee of Sexually Assaulting 8-Year-Old Boy at NRG Stadium During Texans Game

 A lawsuit filed in Harris County accuses an Aramark employee at NRG Stadium of sexually assaulting an 8-year-old boy in a restroom during a Houston Texans football game on Dec. 14. The employee was arrested following the incident and is awaiting trial. 

Aramark Sports and Entertainment Services of Texas LLC and ASM Global Parent Inc., which manages the Harris County-owned NRG Park, are defendants in the case along with Ushay Nixon, an Aramark employee, whom police are charging with indecency with a child and attempted aggravated sexual assault of a child under age 14 in connection with the incident.  

“This case is every parent’s worst nightmare. An 8-year-old boy went to his first NFL game expecting excitement and joy, and instead he was targeted by an employee who never should have been allowed anywhere near children,” said partner and sexual assault attorney Anna Greenberg, who represents the family. “Companies that invite families into massive public venues have a non-negotiable duty to protect them, and when they fail, they must be held accountable.” 

According to the police report and civil complaint, after the boy’s mother escorted him to the men’s restroom and waited for him outside, Nixon approached the child, directed him into a stall and once inside, locked the door. Nixon then removed the child’s pants and underwear and instructed him to face the toilet.  

The child followed the instructions of the employee, the complaint says. When the child looked behind him, he “saw Nixon undo his belt and drop his own pants.” Not trusting Nixon, the child pushed past him, unlocked the stall, and got away.  

When the boy’s mother saw him exit the men’s restroom, she noticed him adjusting his pants. As they returned to their seats, a Good Samaritan approached her and said he had observed Nixon with her son in the restroom and that the interaction “just didn’t look right.” 

After his mother asked him if anything happened in the restroom, the child said, “A man pulled my pants down.” Quickly returning to the area near the men’s restroom with his father, the boy identified Nixon by pointing at him, and Houston police later placed him under arrest. Video surveillance footage from the stadium corroborates the child’s account.  

According to the lawsuit, Nixon had a documented history of sexual misconduct before he was hired by Aramark, including prior criminal charges in Harris County for indecency with a child and indecent assault.  

The filing further alleges that those records reflected a pattern of predatory behavior, including prior incidents involving minors, yet Nixon was nevertheless hired and placed in a position that allowed him unsupervised access to children at one of Texas’s largest public venues. 

The suit alleges that Aramark’s negligence and gross negligence in hiring Nixon permitted him to sexually assault the minor child. 

“When a company hires someone with a known history of sexual misconduct and places them in a position with access to children, that is not just negligence. It is a complete disregard for the safety of children and their families. This lawsuit is about making sure that kind of failure is never repeated,” said Ms. Greenberg. 

Ms. Greenberg said the family is seeking to identify the Good Samaritan whose intervention and information helped lead to Nixon’s arrest. Nixon is being held in the Harris County Jail. 

The case is ES and JS, as next friends of JRS, vs. Aramark Sports and Entertainment Services of Texas LLC, ASM Global Parent Inc. and Ushay Marquise Nixon, Cause No. 2026-02123, filed in the Harris County 113th district court.

Nurse Files Lawsuit in Memorial Hermann Hospital Hidden Camera Scandal

Victim claims she was secretly recorded by ex-patient care director Robert Shrader

THE WOODLANDS, Texas – A nurse at Memorial Hermann Hospital in The Woodlands has filed a lawsuit against the hospital’s former patient care director, alleging he secretly placed hidden cameras in hospital restrooms to record her, fellow employees and patients. 

“This was an outrageous breach of trust and a traumatic violation of my client’s privacy,” said sexual assault attorney Anna Greenberg, who represents the victim. “My client is coming forward not only to seek justice, but also to give a voice to all the victims whose dignity was taken from them.” 


According to the lawsuit, the hospital’s construction team was conducting routine maintenance in August 2025 when it discovered a hidden camera installed in a single-stall bathroom on the second floor. The hospital notified staff of the discovery and confirmed in an internal email that it was placed there by an employee, later identified as patient care director Robert Shrader.

Shrader managed the medical surgical unit nurses, including the victim, identified by her initials as A.D. in the lawsuit. The lawsuit also details how A.D. regularly used the second-floor restroom where the first camera was discovered.  

According to Montgomery County sheriff’s investigators, more than 300 videos and images of at least seven victims were identified from multiple hidden cameras. Officials say the SD card content revealed footage of Shrader installing the device, as well as recordings of staff and patients in various stages of undress. 

Shrader was arrested and charged with seven counts of felony invasive visual recording. He later posted bond and was released.  

The case is A.D. v. Robert Pinon Shrader, Cause No. 25-09-14572 in the 457th Judicial District Court in Montgomery County.

Houston Sexual Assault Attorney Anna Greenberg Featured in Dallas Morning News Coverage of Trey’s Law

The Dallas Morning News recently featured name partner Anna Greenberg in an article examining the impact of Trey’s Law, which bans the use of nondisclosure agreements (NDAs) to silence sexual assault survivors in Texas. 

Trey’s Law, which went into effect on Sept. 1, 2025, prohibits the use of NDAs in both settlements and employment contracts involving sexual assault, aggravated sexual assault, human trafficking and/or child sexual abuse. The law applies retroactively to existing NDAs and is expected to have a significant effect on civil sex abuse and assault cases, where confidentiality clauses have long been a central point of negotiation. 

“The defendants, any time a case settles, are desperate to make sure there’s no more attention on this case,” sexual assault attorney Ms. Greenberg told the DMN. “This law really prohibits them from doing that in the future.” 

The article emphasized that Trey’s Law changes the landscape for survivors pursuing civil claims. Unlike criminal cases, which require proof beyond a reasonable doubt, civil cases can offer survivors meaningful financial recovery for medical expenses, therapy and other damages. By eliminating NDAs, Trey’s Law removes what attorneys describe as a form of “secondary victimization” that silenced survivors post-settlement.

Woman Sues Austin Massage Envy for Sexual Assault

‘Systemic problem;’ Blizzard Greenberg case alleges negligent hiring practices, supervision 

AUSTIN – The sexual assault attorneys with Blizzard Greenberg PLLC have filed another lawsuit against Massage Envy, this time targeting an Austin-area location after a reported assault on a frequent customer during a massage appointment.  

“This company’s failure to protect its customers and employees is tragic and inexcusable,” said trial lawyer Anna Greenberg. “Sexual misconduct at Massage Envy is a well-documented risk, and the company should be doing everything possible to eliminate this risk, but it’s not. It’s a systemic problem.” 

According to the complaint, S.H., a regular customer with a Massage Envy membership, attended a massage appointment in July 2024 with therapist Juan Alberto Bastida. Midway through the session, the lawsuit says Bastida groped her breast and digitally penetrated her. To get Bastida to stop, S.H. told him that she thought the time was up. He then quickly threw the blanket over her and left the room. 

The Austin Police Department has since issued a warrant for Bastida’s arrest.  

The lawsuit claims Massage Envy failed to properly vet, train, and supervise its employees, including the accused therapist, who has a criminal background including a 2002 burglary case and a 2015 assault in a domestic violence case. The filing says that the franchisee who owns and operates the Circle C Ranch Massage Envy location, either “knowingly hired Bastida as a massage therapist despite his criminal history, or it negligently failed to discover this history.” 

The case is S.H. v. Helix2 Spas Austin, LLC, Cause No. D-1-GN-25-001369, in Travis County.  

This lawsuit is just the latest in a disturbing string of claims against Massage Envy franchises across the state, which allege systemic issues that have left customers and employees vulnerable to sexual assault. Within the last year, Blizzard Greenberg attorneys have filed sexual assault cases on behalf of five victims against the company and its franchises.

Another Houston-Area Massage Envy Hit with Sexual Assault Lawsuit

Blizzard Greenberg lawyer: company’s continuing failure to protect women is ‘maddening’

HOUSTON – A massage therapist working at a Houston-area Massage Envy location has filed suit against the company saying a male co-worker sexually assaulted her during a massage. 

The case is the latest in a string of sexual assault claims involving Houston-area Massage Envy franchises and parent company, Scottsdale, Arizona-based Massage Envy Franchising. Some of the suits allege an extensive cover-up to protect the brand and ensure that unsuspecting women would not become aware of the risks associated with the company.  

“The company has known for years about these kinds of assaults committed by Massage Envy therapists,” said trial lawyer Anna Greenberg. “But Massage Envy continuously fails to protect its customers and employees from assault. It’s maddening.” 

In the most recent claim, a Houston-area certified massage therapist identified in the suit as M.K., made a massage appointment with a male co-worker, also a massage therapist, in February 2024. After a routine start to the session, the filing says, things took a turn when the man turned M.K. onto her stomach.  

According to the complaint, the therapist slid his hand between M.K.’s thighs with his hand facing upwards and groped her genital area. M.K. reported the incident to Massage Envy management and the police. The therapist was eventually terminated from the Clear Lake location.  

“He knew what was allowed and what was not allowed, and he intentionally violated my client,” said Ms. Greenberg. “And in doing that, he stole something very significant. Not only did he take away her sense of safety and security, but he also stole her passion for helping others through massage therapy.” 

This case is M.K. v Massage Envy Franchising, LLC et al., Cause no. 2024-49915 in Harris County.

Former Employee Sues Massage Envy Over Sexual Assault

New lawsuit claims therapist transferred to another DFW location

DALLAS – Attorneys with Blizzard Greenberg have filed another lawsuit against Massage Envy, this time on behalf of a massage therapist in Dallas who says she was sexually assaulted by a male co-worker during a massage appointment.

 

“Accusations of sexual assault are supposed to be zero-tolerance offenses, according to Massage Envy’s own policies,” said trial lawyer Anna Greenberg. “Rather than terminating the therapist, this franchisee allowed him to continue working, having access to other women. It makes you wonder how often this happens.” 

The lawsuit filed in Dallas County describes a case in which a longtime Massage Envy employee, identified as R.Q. in the complaint, booked a massage appointment with a male co-worker to treat upper neck and back pain. According to the lawsuit, during the session, the massage therapist slid his hands under R.Q.’s underwear and groped her multiple times after she insisted that he stop. 

R.Q. reported the assault to Massage Envy management, who in turn informed the assailant of her complaint. Rather than following company policy and terminating the therapist immediately, management allowed him to undergo additional training on draping procedures – training that he had been required to redo multiple times before this offense.  

Weeks later, R.Q. was told the company moved the therapist to a Massage Envy location in Fort Worth. That location is the focus of another recent lawsuit claiming sexual assault by another therapist. Eventually, the company terminated the attacker in R.Q.’s case. She also reported the attack to the Dallas Police Department. 

Just last year, attorneys at Blizzard Greenberg secured a maximum policy limits settlement against another Massage Envy location in Houston on behalf of multiple sexual assault victims. Since then, the firm has filed more cases against the company, alleging a pattern of misconduct. 

“Massage Envy’s culture of cover-ups and negligence is extremely dangerous,” said Ms. Greenberg. “The lawless cycle of inconsequential trainings and employee transfers does nothing to protect customers and fellow employees from harm.” 

The latest case is R.Q. v Massage Envy Franchising, LLC, et al., cause number CC-24-04079-E in Dallas County.

Woman Kidnapped, Assaulted While Working as Lyft Driver Sues Rideshare Company

Blizzard Greenberg complaint alleges crime spree targeting drivers

HOUSTON – A Houston-area woman who was sexually assaulted and held at gunpoint while working as a Lyft driver has filed a lawsuit against the company.

Attorneys at Blizzard Greenberg represent the victim, identified as J.W., in the lawsuit filed against Lyft and the attacker, Kenneth Kelley, who police say they later connected to a robbery ring responsible for a string of crimes against more than a dozen rideshare drivers. 

A federal grand jury in Houston recently indicted Kelley and five others on a combined 24 counts including interference with commerce by robbery and using and carrying a firearm during and in relation to a crime of violence. 

“My client was terrified of losing her life over a $3.94 ride,” said sexual assault lawyer Anna Greenberg. “Lyft’s safety policies are inadequate and are geared towards protecting passengers, rather than both passengers and drivers. This horrifying incident could have been avoided if only the company would make driver safety a priority too.” 

J.W. was working part time as a Lyft driver in June 2023 for extra income when she declined a ride request because she wanted to end her shift and return home to her family. Through the Lyft app, the company then sent her a warning that declining rides can result in penalties for drivers, including loss of the ability to drive for the company. A second request came through from the same passenger and she accepted. 

J.W. picked up the passenger, identified as Kelley, and was approaching the drop-off location when the lawsuit says he pulled out a gun, held it to her head and demanded that she continue driving.  

According to the lawsuit, Kelley began describing the sexual things he planned to do to her, including holding a gun to the back of her head while assaulting her. Terrified, J.W. began praying out loud and began talking with the attacker in hopes he would let her live. 

After pulling into a dead-end street, Kelley told J.W. to get out of the car and she says he sexually assaulted her. J.W. was able to get back into her car and drive away after promising Kelley she would return to pick him up later. Instead, she contacted police. 

Officers with the Houston Police Department arrested Kelley along with his co-conspirators, who are accused of a nearly three-month-long crime spree involving abducting, robbing and assaulting rideshare drivers. 

According to the lawsuit, public records show Kelley’s first Lyft victim was kidnapped and robbed in April of 2023. The driver reported the crimes to the company, which failed to timely inform police and allowed Kelley to continue to use the Lyft App. The complaint alleges this negligence led to the crimes against other rideshare drivers and the attack on J.W. 

In addition to the federal charges, Kelley has been indicted on 10 state criminal charges, including aggravated assault with a deadly weapon, aggravated kidnapping and sexual assault. He was taken into custody by U.S. Marshals. 

The case is J.W. v Lyft, Inc. et al., cause number 2024-33708 in Harris County District Court.

Woman Sues Dollar Tree Following Sexual Assault at River Oaks Area Store

‘We got another one:’ complaint alleges three such assaults within four days

HOUSTON – A Houston woman has filed suit against Dollar Tree after she was sexually assaulted at the company’s River Oaks area store last December. 

 

 

Attorneys at Blizzard Greenberg are suing Dollar Tree for negligence after a shopper was followed and harassed by another customer, who she later discovered ejaculated on her. 

 

“It is shocking and despicable,” said sexual assault lawyer Anna Greenberg. “How was a complete stranger able to violate my client in the middle of a weekday morning? That alone speaks to the fact Dollar Tree is not maintaining a safe environment for the people who shop there.” 

 

The plaintiff, identified as M.R. in the lawsuit, was visiting the Dollar Tree in the River Oaks area with a friend when a man approached her from behind and began saying sexually explicit things to her. Disturbed, the women hurried to check out, paid for a few items and left the store. 

 

According to the lawsuit, as they got into their car, M.R.’s friend pointed out a white, sticky substance on M.R.’s back, which turned out to be semen. 

 

The women preserved the evidence and reported the incident to Dollar Tree and the Houston Police Department. The lawsuit states the store clerk told the women that this was the third such assault in four days, shouting “we got another one” to the manager on duty. 

 

The attorneys allege Dollar Tree creates a dangerous condition by understaffing its stores, which contributes to their longstanding history of theft, robbery and other issues with violent crimes. 

 

“Dollar Tree has a reputation as being an easy target for criminals,” said Ms. Greenberg. “Rather than addressing their staffing issues head-on, the company continues to disregard safety for customers and employees alike.” 

 

Since the assault, M.R. has reported nightmares and high levels of stress and anxiety. She says she is especially fearful around men and finds it difficult to shop anywhere without constantly looking over her shoulder.

Attorneys File Sexual Assault Lawsuit Against Fort Worth Massage Envy

Blizzard Greenberg alleges systemic problem with sexual assaults at the company

FORT WORTH – Attorneys at Blizzard Greenberg have filed a lawsuit against a Fort Worth-area Massage Envy on behalf of a woman who was sexually assaulted during her appointment. 

“There are hundreds of known reports of sexual assault at Massage Envy franchises all over the country,” said trial lawyer Anna Greenberg. “The company fosters a secretive and negligent environment at the expense of their paying customers.” 

The complaint describes how a Fort Worth woman, identified as A.C. in the lawsuit, was gifted a full-body massage appointment with Massage Envy by her husband. At the beginning of the session, the male massage therapist made inappropriate comments to A.C.  

About halfway through the appointment, the lawsuit says A.C. dozed off and woke up to the masseur groping her breasts. After expressing her distress and asking the man to stop, the complaint accuses him of then massaging her buttocks with the sheet completely down. She again told him to stop, at which point he began massaging her upper thighs between her legs and attempted to pull her legs apart. 

According to the lawsuit, A.C. ended the appointment and left in a panic. She called her husband crying and the two reported the incident to Massage Envy and Fort Worth police. 

“This is a systemic problem with Massage Envy,” said Ms. Greenberg. “The company must begin implementing updated safety procedures to ensure more women do not fall victim to negligent hiring and training practices.” 

Just last year, attorneys at Blizzard Greenberg secured a maximum policy limits settlement against another Massage Envy location in Houston on behalf of multiple sexual assault victims. 

The new case is A.C. v Massage Envy Franchising, LLC, et al., cause number 348-352233-24 in Tarrant County District Court.
